Jill Braunwald Porter is an experienced health care attorney at Ankner & Levy, PC advising clients on a broad range of regulatory and transactional matters. Jill works with traditional health care providers as well as third parties that provide products and services to health care providers such as drug manufacturers, medical device companies, software developers and others at the intersection of health care and technology.
A sizeable portion of Jill’s practice involves privacy, digital health and health data. Many of her clients are start-ups and software developers for whom Jill helps decipher the multitude of health care regulations. Jill counsels clients on a wide range of health care data privacy and HIPAA issues, including preparing website privacy policies and terms of use, providing advice on ability to use and share health information, negotiating business associate agreements, counseling on health data issues in the context of acquisitions, and assisting with data breaches.
Jill’s practice involves advising individual health care providers, medical and behavioral health practices, hospitals, home health agencies, long term care facilities, IT vendors, and drug and medical device manufacturers in a variety of activities including:
- Contract Review – drafting and negotiating provider participation and services arrangements; reviewing employment, medical director, and consulting agreements; reviewing contracts with commercial payors and TPAs; and providing advice on IT vendor contracts for both suppliers and customers
- Business Matters - formation of LLCs, PCs and other business entities; providing advice on health care regulatory matters in corporate transactions including issues related to indemnification and changes of ownership; preparing shareholder agreements, operating agreements, and corporate and medical staff bylaws; and assisting with medical practice buy-ins/outs
- Clinical Trial Settings - negotiating CTAs with focus on indemnification, data use ,and ownership issues; and providing counsel on risk management issues following data breaches
- Informed Consent and HIPAA Authorizations
Jill has practiced at Ankner & Levy, PC for close to fifteen years. In the past, Jill was a partner in the health law department of McDermott Will & Emery, an Associate General Counsel in the dialysis and homecare divisions at Fresenius Medical Care NA, and got her start at Hutchins & Wheeler. Jill earned her law degree, cum laude, from Georgetown University and her bachelor’s degree, cum laude, from Bucknell University. She is a member of the American Health Lawyers Association, the Food and Drug Law Institute, and the World Association for Medical Law. She serves on the Advisory Board for the Bioethics and Law Initiative at Tel Aviv University.
